Mama Ngina na Criticos warejea kortini kupigania shamba Taita Taveta

Mama Ngina Kenyatta na Basil Criticos wamerejea mahakamani wakidai umiliki wa shamba la ekari 2,624 katika Kaunti ya Taita Taveta. Wanadai Msajili Mkuu wa Ardhi amepuuza amri ya mahakama iliyotolewa Desemba mwaka jana. Mahakama imekataa kutoa nafasi ya dharura na kuwapa washtakiwa siku 15 kujibu.

Mama Ngina Kenyatta, aliyekuwa Mama wa Taifa, na Basil Criticos, aliyekuwa Mbunge wa Taveta, wamewasilisha kesi katika Mahakama ya Mazingira na Ardhi jijini Nairobi. Wanataka maafisa wa ardhi kufanya kazi ya kuhamisha umiliki wa shamba la ekari 2,624, linalojulikana kama LR 10287/7 katika East Taita Township, kwa majina yao.

Kulingana na hati za kesi, Msajili Mkuu wa Ardhi amekataa kutimiza amri ya mahakama ya Desemba 11 mwaka jana, ambayo ilimtaka atoe cheti cha umiliki na afute rekodi haramu. Wanataka mahakama imwite msajili huyo aeleze sababu za kutotimiza amri hiyo.

Katika kiapo chake, Criticos alisema, “Mshtakiwa wa kwanza, ambaye ni Msajili Mkuu wa Ardhi, amekataa kutoa cheti cha muda cha umiliki au kuwasilisha ripoti ya utekelezaji ndani ya siku 14 licha ya kukumbushwa mara kadhaa.” Aliongeza kuwa mawakili wao waliandikia barua Desemba 17 na Januari 13 bila kupata majibu.

Mawakili wao wanataka mahakama iagize kuchapisha katika Gazeti Rasmi kufutwa kwa hati haramu na ripoti ya utekelezaji. Mzozo huu umekuwa ukiongoza kwa miaka mingi, ukihusisha watu binafsi, serikali na makazi ya walowezi.

Hata hivyo, hakimu alikataa kutoa amri ya dharura na kuwahimiza walalamishi kuwakabidhi washtakiwa, ikiwa ni pamoja na Mwanasheria Mkuu na Msajili Mkuu wa Ardhi, stakabadhi za kesi. Walishauriwa kuwapa siku 15 kujibu.

Shamba hili limekuwa chanzo cha migogoro ya umiliki na masuala ya makazi.
