The High Court in Nairobi has ruled that President William Ruto's taskforce to audit public debt is unconstitutional. Justice Lawrence Mugambi delivered the decision on July 23, 2026. The ruling follows a petition by activist Magare Gikenyi.
The court found that the taskforce's mandate overlaps with the constitutional role of the Auditor-General. Petitioners argued the body was formed without public participation and that member appointments lacked merit and transparency.
Justice Mugambi stated that presidential powers must stay within constitutional limits. The government had defended the taskforce as an advisory group created under executive authority.
Ruto established the eight-member panel in July 2024. It was tasked with submitting a report within three months. Members included Philip Kaikai, Shammah Kiteme and Vincent Kimosop. Former Law Society of Kenya President Faith Odhiambo declined her appointment.
