La RBI interdit aux banques et aux sociétés financières non bancaires de revendre des actifs en difficulté

La Reserve Bank of India a introduit de nouvelles normes prudentielles qui interdiront aux prêteurs de revendre des actifs en difficulté acquis à des emprunteurs défaillants ou à des parties liées. Ces règles s'appliqueront aux banques, aux petites banques de financement et aux sociétés financières non bancaires à compter d'octobre 2026.

Les normes couvrent certains actifs non financiers obtenus lors de la résolution de prêts en difficulté. Les prêteurs doivent établir des politiques approuvées par leur conseil d'administration pour l'acquisition et la cession de ces actifs.

Les actifs doivent figurer séparément au bilan et non en tant qu'actifs non performants. Ce changement vise à renforcer la transparence dans la gestion des actifs.

La réglementation entrera en vigueur en octobre 2026 et s'appliquera à l'ensemble des institutions concernées.
