Mahakama ya Juu imezuia Shirikisho la Wateja la Kenya (COFEK) kuondoa ombi lake dhidi ya mkataba wa kushiriki data ya afya kati ya Kenya na Marekani. Katiba Institute ilipinga uamuzi huo, na hakimu alikubali. Kesi itasikilizwa Mei 25.

COFEK alifikia makubaliano ya ridhaa na serikali na akaomba kuondoa ombi. Hata hivyo, Katiba Institute, kupitia mwanasheria Joshua Malidzo, walipinga, wakisema kesi za maslahi ya umma zinazohusu masuala ya katiba haziwezi kutatuliwa kwa makubaliano ya kibinafsi.

Hakimu Patricia Nyaundi alikubali pingamizi hilo, akisisitiza kuwa kesi za maslahi ya umma lazima ziwe chini ya udhibiti wa mahakama. "Mambo yanayoathiri umma hayawezi kufutwa kwa ridhaa tu wakati masuala ya katiba bado hayajatuliwa," alisema Nyaundi. Seneta wa Busia Okiya Omtatah pia ameonyesha nia ya kufuate kesi katika ombi lake la 2025.

Mkataba unahusisha Marekani kutoa zaidi ya Ksh200 bilioni kwa afya kupitia serikali kwa miaka mitano, badala ya muundo wa wafadhili.
