Nagpapatibay ng Court of Appeals ang legalidad ng search warrants laban kay Teves

Itinanggi ng Court of Appeals Third Division ang petisyon ni dating kongresista Arnolfo Teves Jr. na naglalayong baliwalain ang search warrants at i-suppress ang ebidensyang nakuha sa raid noong 2023. MANILA, Philippines — Nagdesisyon ang Court of Appeals (CA) Third Division na walang bisa ang petisyon for certiorari ni Arnolfo Teves Jr. na inihain laban sa mga order ng Regional Trial Court (RTC) ng Manila, Branch 12 noong Agosto 28, 2025 at Oktubre 2, 2025.

Ang mga order na ito ay tumanggi sa omnibus motion niya na quash ang dalawang search warrants at i-suppress ang ebidensya mula sa raid noong Marso 10, 2023 sa kanyang propert sa Barangay Malabugas, Bayawan City. Ang mga warrant ay para sa mga paglabag sa Comprehensive Firearms and Ammunition Regulation Act at Law on Explosives. Natuklasan ng mga awtoridad ang M14 at M16 rifles, M203 grenade launcher, hand grenades at libu-libong rounds ng ammunition.

Ipinagtapat ni Teves na walang probable cause ang warrants dahil sa "deceitful and perjured testimony" ni Gemuel Hobro, na nagsabing miyembro siya ng "liquidation squad" ng pamilya Teves sa loob ng 14 taon. Bukod dito, sinabi niyang limitado lamang sa tatlong bedrooms ang search batay sa sketch map.

Walang merit ang mga argumento ni Teves, ayon sa CA. Ang determinasyon ng probable cause ng judge ay may great deference, at personal na tiningnan ang testimonya ni Hobro kaya hindi hearsay.
