Le président du tribunal du Cap-Oriental recommandé pour suspension

La Commission des services judiciaires a recommandé la suspension formelle du président du tribunal du Cap-Oriental, Selby Mbenenge, dans l'attente d'une procédure de destitution à la suite de conclusions de faute grave liées à des allégations de harcèlement sexuel.

Mbenenge est en congé spécial depuis 2023 à la suite d'accusations selon lesquelles il aurait harcelé sexuellement une secrétaire subalterne du tribunal. Un tribunal de conduite judiciaire a statué en janvier qu'il n'était coupable que d'un certain degré d'inconduite après avoir examiné des preuves, notamment des messages et des émojis.

La JSC a rejeté cette conclusion en avril et a plutôt recommandé la destitution, invoquant un déséquilibre des pouvoirs et qualifiant le harcèlement sexuel d'affront à la fonction judiciaire. Mbenenge a contesté la décision devant la Haute Cour de Pretoria, la qualifiant de déraisonnable et illégale.

Lors de sa réunion de juin, la JSC a décidé de recommander la suspension au président Cyril Ramaphosa. Elle a déclaré que la suspension formelle est une mesure de précaution visant à protéger l'intégrité du pouvoir judiciaire pendant que la procédure de révocation se poursuit, et a pris note des observations présentées tant par Mbenenge que par la plaignante, Andiswa Mengo.
