High court orders NTSA to record automatic traffic fines

The Kiambu High Court has directed the National Transport and Safety Authority to keep detailed records of all payments made under its new instant traffic fines system while a petition challenging the system is heard.

Justice Bahati Mwamuye issued the conservatory orders on Friday, May 29. The orders require NTSA to maintain a structured schedule of every payment linked to instant or automatic fines.

The ruling stays in force until the petition filed by Wilberforce Akelo is heard and determined. The court has scheduled the next hearing for June 4.

NTSA had announced that the digital fines system would start on June 1. Under the system drivers receive a notification on their phones and may pay the fine or choose to appear in court.

The court warned that failure to comply with the orders could result in penal consequences.
