Duterte se someterá a una nueva evaluación de aptitud para el juicio ante la CPI

El expresidente Rodrigo Duterte se someterá a otra evaluación médica para determinar si es apto para enfrentar un juicio ante la Corte Penal Internacional. La Sala de Cuestiones Preliminares III de la CPI aprobó la solicitud de la defensa para realizar el examen bajo la Regla 135. La jueza presidenta Joanna Korner ordenó la nueva revisión durante una conferencia de estado.

La CPI publicó el viernes la versión redactada de la presentación de la defensa realizada por el abogado principal Peter Haynes el 25 de mayo. Haynes señaló que el examen anterior cubría solo la etapa previa al juicio y que han pasado más de seis meses desde entonces.

La jueza Korner declaró durante la conferencia del miércoles que se requiere una determinación separada sobre la aptitud para la fase de juicio. La sala concedió la solicitud e instruyó a los expertos a realizar la evaluación.

La Regla 135 permite a la Sala de Primera Instancia ordenar exámenes médicos. Si se determina que el acusado no es apto, el juicio debe suspenderse con revisiones cada 120 días.
