Cámara de Comercio de Tunja enfrenta fallo que ordena reintegro de expresidente

Un juez de Tunja ordenó el reintegro de John Jairo Martínez Álvarez como presidente ejecutivo de la Cámara de Comercio de Tunja, tras una acción de tutela. La decisión genera la posibilidad de dos presidentes en la entidad, que cubre 71 municipios y maneja un presupuesto superior a $15.000 millones.

La Junta Directiva de la Cámara de Comercio de Tunja removió a John Jairo Martínez Álvarez de la presidencia ejecutiva, cargo que ocupaba desde octubre de 2024 por un año y medio. Dos meses y medio después, nombraron a Sergio Armando Tolosa Acevedo en su lugar.

Martínez Álvarez interpuso una acción de tutela argumentando que su salida fue arbitraria, violando sus derechos al mínimo vital y a la seguridad social, especialmente al estar próximo a su pensión.

El Juzgado Cuarto Civil del Circuito de Oralidad de Tunja, en segunda instancia, tuteló esos derechos y ordenó: “Tutelar los derechos fundamentales al mínimo vital y a la seguridad social del accionante, vulnerados por la decisión de la Junta Directiva de removerlo del cargo de Presidente Ejecutivo sin realizar la ponderación constitucional exigida y ordenar a la Cámara de Comercio de Tunja que, dentro de las 48 horas siguientes a la notificación de esta providencia, reintegre al señor John Jairo Martínez Álvarez al cargo de Presidente Ejecutivo o a uno de igual o superior jerarquía”.

Esta providencia podría resultar en dos presidentes ejecutivos simultáneos en la entidad, que abarca 71 de los 123 municipios del departamento.
