Everstrong Capital to appeal after losing Nairobi-Mombasa expressway petition

Everstrong Capital is considering an appeal to the High Court after the Public Private Partnerships Petitions Committee rejected its challenge to the cancellation of the Ksh468 billion Usahihi Nairobi-Mombasa Expressway project.

The United States-based infrastructure firm expressed disappointment with the ruling but said it remains committed to working with the Kenyan government on the project. In a statement, Everstrong noted that the committee's decision did not address key concerns about the evaluation of the project's feasibility report.

The company said it is evaluating options including a review application before the High Court of Kenya. It warned that uncertainty over privately financed infrastructure proposals could harm investor confidence and raise costs for national projects.

The proposed four-to-six-lane expressway was developed under Kenya's PPP framework by a consortium led by Everstrong Capital. The group had already invested millions of dollars in studies and designs with guidance from KeNHA and the PPP Unit.
