Michigan issues permits for Line 5 tunnel despite opposition

State regulators approved key permits on Wednesday for a tunnel to replace an aging section of the Line 5 pipeline under the Straits of Mackinac. Officials determined that the project outweighs concerns over ecological and tribal impacts.

The Department of Environment, Great Lakes, and Energy approved a construction permit for lake bottomlands. The Department of Natural Resources also granted a permit, requiring Enbridge to minimize damage to wetlands and follow measures such as winter tree clearing to protect bats.

Enbridge spokesperson Ryan Duffy called the permits an important step forward that will ensure the uninterrupted flow of energy. The company is reviewing the documents to assess impacts on tunnel construction.

Opponents including David Holtz of Oil & Water Don’t Mix criticized the decisions, arguing there should be no wetlands or forest destruction for an unneeded project. Whitney Gravelle, president of the Bay Mills Indian Community, described the approvals as a setback that disrespects tribal ancestors and called any mitigation plan false penitence.

Enbridge still needs additional state and federal permits plus a court decision before construction can begin. The Bay Mills Indian Community is exploring legal options such as a contested case hearing.
