Un second congé maternité ne peut être refusé en raison d'un écart de deux ans : la Haute Cour d'Allahabad

La Haute Cour d'Allahabad a statué mardi qu'un second congé maternité ne pouvait être refusé au motif qu'il y aurait un écart de deux ans entre les enfants. Le juge Karunesh Singh Pawar a rendu ce jugement dans l'affaire Manisha Yadav.

La Haute Cour d'Allahabad a déclaré que le Maternity Benefit Act, une loi promulguée par le Parlement, prévaudrait sur toute instruction exécutive ou disposition figurant dans le manuel financier. En cas d'incohérence, les dispositions de la loi auraient un effet prépondérant, a précisé le tribunal en se référant à des décisions antérieures. Le juge Karunesh Singh Pawar, siégeant en juge unique, a classé la requête de Manisha Yadav avec ces directives. Cette décision renforce les droits à la maternité des fonctionnaires, notamment en ce qui concerne le congé pour un second enfant.
