दो साल के अंतर पर दूसरी मैटरनिटी लीव से इंकार नहीं: इलाहाबाद हाईकोर्ट

इलाहाबाद हाईकोर्ट ने मंगलवार को फैसला सुनाया कि बच्चों के जन्म में दो साल के अंतराल के आधार पर दूसरी प्रसूति अवकाश से इंकार नहीं किया जा सकता। जस्टिस करुणेश सिंह पवार ने मनीषा यादव की याचिका पर यह फैसला दिया।

इलाहाबाद हाईकोर्ट ने स्पष्ट किया कि मैटरनिटी बेनिफिट एक्ट, जो संसद द्वारा बनाया गया कानून है, किसी भी कार्यकारी निर्देशों या वित्तीय हैंडबुक के प्रावधानों पर प्रबल होगा।

यदि कोई असंगति हो, तो एक्ट के प्रावधानों का प्रभावी होगा, कोर्ट ने पूर्व फैसलों का हवाला देते हुए कहा। जस्टिस करुणेश सिंह पवार की एकलपीठ ने मनीषा यादव की याचिका का निपटारा करते हुए यह निर्देश दिया।

यह फैसला सरकारी कर्मचारियों के लिए प्रसूति लाभों को मजबूत करता है, खासकर दूसरे बच्चे के लिए लीव के मामले में।
