सुप्रीम कोर्ट ने धार्मिक विवादों में केस-दर-केस जांच का संकेत दिया

सुप्रीम कोर्ट ने बुधवार को धार्मिक स्वतंत्रता और मौलिक अधिकारों के बीच विवादों में न्यायिक हस्तक्षेप के लिए एकसमान दिशानिर्देश बनाने से इनकार किया, केस-दर-केस मूल्यांकन पर जोर दिया। यह टिप्पणी सबरीमाला मंदिर प्रवेश मामले से जुड़े संदर्भ की सुनवाई के सातवें दिन आई।

नई दिल्ली में सुप्रीम कोर्ट की नौ जजों की बेंच ने सबरीमाला मंदिर में महिलाओं के प्रवेश से जुड़े 2018 के फैसले की समीक्षा याचिकाओं पर सुनवाई की। चीफ जस्टिस सुर्या कांत की अगुवाई वाली बेंच में जस्टिस बीवी नागरत्ना, एमएम सुंदरेश, अहसनुद्दीन अमानुल्लाह, अरविंद कुमार, ऑगस्टाइन जॉर्ज मसीह, आर महादेवन, प्रसन्ना बी वराले और जोयमलया बागची शामिल हैं।

चीफ जस्टिस कांत ने कहा, "सामाजिक कल्याण या सुधारों के मामले में यह बहुत व्यापक शब्द है... लेकिन भविष्य के लिए कोई दिशानिर्देश देना बहुत कठिन है। यह हमेशा केस-दर-केस निर्भर करेगा कि सुधार अनुच्छेद 25(2)(ब) के अंतर्गत आते हैं या धार्मिक प्रथा का उल्लंघन करते हैं।"

वरिष्ठ अधिवक्ता गोपाल सुब्रमण्यम ने अनुच्छेद 25 और 26 के बीच संतुलन पर बहस की। जस्टिस नागरत्ना ने सबरीमाला में सभी उम्र की महिलाओं के प्रवेश को सुधार के रूप में मानने पर सवाल उठाया। जस्टिस बागची ने अनुच्छेद 25(2)(ब) को 'संकीर्ण खिड़की' बताया।

बेंच ने आवश्यक धार्मिक प्रथाओं (ईआरपी) सिद्धांत पर भी चर्चा की। सुब्रमण्यम ने कहा कि अदालतों को प्रथा की प्रकृति की जांच करनी चाहिए। सुनवाई गुरुवार को जारी रहेगी।

इसके अलावा, दावूदी बोहरा समुदाय में बहिष्कार प्रथा को चुनौती देने वाली याचिका पर भी चर्चा हुई, जहां जस्टिस नागरत्ना ने याचिका की बनाए रखने योग्यता पर सवाल उठाए।
