Lei de Finanças de 2026 isenta bancos de IVA sobre ativos retomados

A Lei de Finanças de 2026, assinada pelo presidente William Ruto em 23 de junho, isenta bancos, SACCOs e outras instituições financeiras do IVA sobre a venda de garantias retomadas.

A emenda adiciona a venda, alienação ou realização de ativos retomados à lista de serviços financeiros isentos nos termos da Lei do IVA. A medida resolve uma disputa na qual a Kenya Revenue Authority buscava a cobrança de 16% de IVA sobre tais transações.

O Tribunal de Recursos Fiscais decidiu em janeiro de 2025 que o processo de recuperação não estava explicitamente coberto pela isenção relativa ao principal do empréstimo. A Kenya Bankers Association havia alertado em maio que o imposto elevaria os custos dos empréstimos e seria repassado aos mutuários.
