O TJUE emitirá decisão sobre a lei de anistia em 16 de julho

O Tribunal de Justiça da União Europeia resolverá em 16 de julho as questões preliminares sobre a lei de anistia levantadas pelo Tribunal de Contas e pela Audiência Nacional.

O serviço de imprensa do TJUE informou em 12 de junho de 2026 que a Grande Câmara do tribunal sediado em Luxemburgo proferirá sua decisão naquele dia. A decisão abordará a aplicação da anistia à responsabilidade contábil pelas despesas do 1-O e aos supostos crimes de terrorismo no caso CDR.

O advogado-geral Dean Spielmann emitiu um parecer não vinculativo em 13 de novembro de 2025. Nele, endossou a compatibilidade da norma com o direito da UE, embora tenha levantado objeções processuais.

A lei de anistia entrou em vigor em 11 de junho de 2024. Dezenas de líderes independentistas, incluindo Carles Puigdemont, aguardam a decisão do tribunal europeu, que também influenciará o Tribunal Constitucional.
