Le panel a estimé que la peine visait en partie à réprimer sa liberté d'expression, ce qu'il a jugé inadmissible, et a renvoyé l'affaire devant le juge du 21e district judiciaire, Matthew Branch, pour une nouvelle détermination de la peine. Aucune date n'a été fixée, et l'éligibilité antérieure de Mme Peters à une libération conditionnelle en novembre 2028 sera modifiée en conséquence.
