Ação judicial é movida contra bancos e fintechs por atrasos na reforma do 4x1000

Um tribunal de Bogotá admitiu uma ação coletiva em agosto de 2025 contra mais de 50 entidades financeiras por supostos danos causados por atrasos na aplicação da reforma tributária do 4x1000.

A ordem do Sétimo Tribunal Civil do Circuito de Bogotá determinou a notificação ao público e a entidades como a Superintendência Financeira e o Ministério da Fazenda. Os réus incluem Bancolombia, Banco de Bogotá, Davivienda, Nu Colombia e Mercado Pago.

A reforma de 2022, sob a Lei 2277, isenta transações mensais de até 350 UVT do imposto 4x1000. Atrasos na interoperabilidade dos sistemas impediram a implementação efetiva, de acordo com reclamações da Nu Colombia.

Jonathan Malagón, presidente da Asobancaria, afirmou que o atraso decorre da exigência legal de participação plena de todas as entidades, e não de falta de disposição do setor. Marcela Torres, da Nu, observou que já se passaram mais de 500 dias sem a implementação.
