Oberste Richterin Koome ordnet Übertragung von Klagen bei Verkehrsunfällen an

Die Oberste Richterin Martha Koome hat angewiesen, dass Personenschadensansprüche aus Verkehrsunfällen von den Small Claims Courts an die Magistrates' Courts in ganz Kenia übertragen werden.

Der in einer Bekanntmachung angekündigte Schritt zielt darauf ab, die Effizienz und den Zugang zur Justiz angesichts der hohen Anzahl solcher Fälle im Small-Claims-System zu verbessern. Koome erklärte am Samstag, dem 9. Mai, dass die Richtlinien für alle Kenianer für mehr Klarheit sorgen werden. Alle übertragenen Angelegenheiten werden ab ihrem derzeitigen Stand fortgesetzt, wobei bestehende Anordnungen ihre Gültigkeit behalten. Die Magistrates' Courts werden die Fälle vorrangig behandeln. Richter der Small Claims Courts können ihre Tätigkeit in ihren neuen Rollen als Magistrates fortsetzen. Für Urteile, die vor dem 22. Januar 2026 ergangen sind, können die Beschlüsse bei beiden Gerichten erwirkt werden. Die empfangenden Gerichte werden bei Bedarf getippte Protokolle zur Verfügung stellen, um die Kontinuität zu wahren.
