Delhi High Court hebt EOW-FIR und ED-Ermittlungen gegen NewsClick auf

Der Delhi High Court hat eine 2020 von der Economic Offences Wing eingereichte FIR sowie die damit verbundenen Verfahren der Enforcement Directorate gegen das Nachrichtenportal NewsClick und dessen Gründer Prabir Purkayastha aufgehoben.

Richterin Neena Bansal Krishna entschied am Mittwoch, dass die Straftatbestände Betrug, Untreue und kriminelle Verschwörung nicht erfüllt seien. Das Gericht stellte fest, dass die Fortführung der am 26. August 2020 eingereichten FIR einen groben Missbrauch des Rechtswegs darstelle. Die FIR hatte Verstöße gegen FDI-Vorschriften bei Investitionen vorgeworfen, die PPK NewsClick Studio Private Limited im Zeitraum 2018-19 von Worldwide Media Holdings LLC erhalten hatte. Die Enforcement Directorate leitete am 2. September 2020 auf Grundlage der FIR Maßnahmen gemäß dem Prevention of Money Laundering Act ein. Purkayastha sagte nach dem Urteil: „Das Urteil hat bestätigt, was wir immer behauptet haben.“ Das Gericht merkte an, dass für den Vorwurf des Betrugs kein Geschädigter existiere und die Reserve Bank of India kein Fehlverhalten festgestellt habe.
