DPR setuju MKMK tak berwenang proses laporan Adies Kadir

Rapat Paripurna DPR RI menyetujui bahwa Majelis Kehormatan Mahkamah Konstitusi (MKMK) tidak berwenang memproses laporan terkait pencalonan Adies Kadir sebagai Hakim MK. Keputusan ini berdasarkan kesimpulan Komisi III DPR, sementara Ketua MKMK menolak membuka isi laporan untuk menjaga independensi. Laporan tersebut diajukan oleh 21 akademisi dan praktisi hukum atas dugaan pelanggaran etik.

Pada Kamis, 19 Februari 2026, Rapat Paripurna Ke-14 DPR RI untuk penutupan Masa Sidang III Tahun Sidang 2025-2026 di Jakarta menyetujui rekomendasi Komisi III bahwa MKMK tidak dapat memproses laporan mengenai proses pencalonan Adies Kadir sebagai Hakim Mahkamah Konstitusi (MK).

Ketua DPR RI Puan Maharani menyatakan bahwa kesimpulan ini membatasi kewenangan MKMK hanya pada penegakan kode etik hakim konstitusi yang sedang menjabat, sesuai Pasal 27A Undang-Undang Nomor 7 Tahun 2020 tentang Mahkamah Konstitusi. "Majelis Kehormatan Mahkamah Konstitusi tidak memiliki kewenangan untuk menindaklanjuti laporan terkait proses mekanisme pemilihan hakim konstitusi oleh seluruh lembaga pengusul," ujar Puan saat memimpin rapat.

Komisi III juga merekomendasikan MK untuk memperjelas tugas dan kewenangan MKMK agar selaras dengan undang-undang tersebut. Anggota DPR yang hadir menyetujui kesimpulan ini.

Sebelumnya, pada Rabu, 18 Februari 2026, dalam rapat Komisi III, Ketua MKMK I Gede Dewa Palguna menolak membuka substansi laporan terhadap Adies Kadir. Ia lebih memilih diberhentikan daripada melanggar sumpah dan independensi. "Jadi sepanjang menyangkut substansi yang sedang kami tangani... tidak bisa kami buka di sini. Tidak mungkin. Karena kami akan menyalahi sumpah kami, kami akan menyalahi hukum acara," kata Palguna.

Adies Kadir, mantan Wakil Ketua DPR RI, dilantik menjadi Hakim MK oleh Presiden Prabowo Subianto setelah pencalonan oleh Komisi III dan persetujuan paripurna DPR. Laporan ke MKMK diajukan oleh 21 anggota Constitutional and Administrative Law Society (CALS), termasuk guru besar dan praktisi hukum, karena dugaan pelanggaran kode etik dan peraturan dalam pencalonannya, demi menjaga martabat Mahkamah.
